The management of the matrimonial assets can be discussed among the parties, and if the property is decided to be retained, then the party holding on to the property has to be eligible to own the property on his or her own both in terms of financially and eligibility criteria.

Hi,

It depends on how both you and spouse decide to deal with the matrimonial property. It is possible to keep but both parties must have an agreement on the finances and future ownership yet and hdb must approve.

Hi,

1) Actually, this is a question that should be brought up to your family lawyer who handles your divorce.
2) One party can only keep the house when he/she meets the eligibility schemes listed by the HDB if this is an HDB flat.
3) Private residential property has no eligibility issue, it is only the affordability that is the main concern.
4) The leaving party can only gift his/her share when the property is free from an outstanding mortgage, and it is bought with cash only.
5) In most cases the retaining party has to apply for a mortgage to buy over the leaving party shares.
6) The minimum that the retaining party has to pay back is the leaving party's utilized CPF plus accrued interest.
7) If your current loan is from the HDB, it is best to speak to the HDB to understand whether you can get a sufficient loan to cover the leaving party's shares' value.
8) If your current loan is from a bank, then you will have to speak to the bank.

Hi,

It's not mandatory to sell your house in the event of a divorce. If it is a private property, the divorced parties can even continue to co-own the property after divorce. If it is a HDB flat, one of the parties will have to "exit", leaving the remaining party to solely own the flat. The terms of the "exit" will have to be discussed between the parties and their representing lawyers, and finally decided by the Final Judgement.
