Hi,
As a LPA donee if I buy a private property with donor's name only, am I subject to ABSD as I already owned a private property? I, as a donee, have the power to decide on property and finance matters.

Hi KH

Are you the sole donee for this donor? It will be ideal to write in to IRAS to clarify. I could be wrong but my understanding is as this would be a purchase under the donor's name, as long as he or she does not own any other residential property, there should not be any ABSD applicable assuming its his or her first property purchase as a singaporean, and it should be the donor's property count that is the issue here, not the donee's. It is best to write in to IRAS to confirm.

Hi,

1) Buying property has nothing to do with LPA.
2) When you buy a private residential property for a person, the IRAS will do the property count according to that person.
3) You are not subject to any ABSD since you are not the owner of the property.
4) The payment mode for the property must be fully in cash and no bank loan.
5) If there is a loan needed for the purchase, it is the person; the beneficial, has to apply for it.

• Since the property is registered solely under the donor’s name, the ABSD will be assessed based on the donor’s ownership status — not yours as the donee.
• However, if the donor already owns private property, they may be liable for ABSD on this additional purchase.
• Your role as donee with authority under the LPA does not create separate ownership for ABSD purposes.
• Make sure the Stamp Duty and IRAS filings correctly reflect this arrangement to avoid issues.

From what I understand, since the property is purchased under the donor's name, the ABSD liability is based on the donor’s property count, not the donee’s.

If the donor is a Singaporean buying their first residential property, ABSD should not apply—but this depends on whether they currently own other residential properties.

That said, situations involving donees and powers of attorney can be nuanced, so it’s strongly advised to write to IRAS for an official clarification.
