Hi all, i have a question. I am a SG citizen and my wife is a foreigner (malaysian) and note that one of the hdb requirements is that both the owner and co-owner/occupier cannot own any local/overseas property but my wife has a joint name title with family in Msia.
If we are planning to buy a resale flat, intend to use my name as owner and wife as occupier then she remains her private property title in Msia due to family staying, did anyone encounter any such case before and it is successful?
If there is any professional agent always deal with such cases, please let me know too. Would greatly appreciate. Thanks!

Good morning,

please appeal with HDB (to hold on the overseas property) before you commit to a purchase.

If not she has to dispose off the overseas property first and both of you observe 15 months waiting period before can buy a resale HDB.

These cases must be appealed to HDB and it will be considered only on case by case basis, meaning no agents can claim that they can help you with such situation with high approval rates.

My question here is if there is a need for your wife's name to remain in the title with her family in the Malaysia property? Is she able to withdraw her name in this case? The appeal could be slightly stronger in this case, if she is able to remove her name from that property, and appeal to HDB based on the 15 months window period that you are not allowed to purchase HDB property, instead of retaining the property.
