Hi, she does not need to decouple to own the flat as long as the flat that she is inheriting has passed the 5year MOP mark. There will not be a new 5years MOP being applied to the flat, but any existing MOP will have to be fulfilled.

Whether your wife is able to inherit the HDB depends on when the HDB was purchased and whether it is a subsidised flat. If the flat is a non subsidised flat purchased before 30th August 2010 then she will be able to inherit and keep the current private property.

- If the wife inherits an HDB while owning a private property, she will need to dispose of the private property within six months, as per HDB rules. Decoupling might not be necessary, but the private property cannot be retained.

- As for the Minimum Occupation Period (MOP), yes, a new 5-year MOP will apply to the inherited HDB, starting from the date of transfer.

- It’s a good idea to check directly with HDB to confirm any updates or specific requirements for your situation.

If the hdb flat is a non subsidised flat and purchased before 30th August 2010 , then she will be able to inherit the hdb and keep the current private property.

However HDB may impose some conditions such as you need to stay in the HDB while renting out the private.

There is no need to decouple from the private property, and typically no need to serve an fresh MOP after inheritance.

The best person to hear inputs from on whether you can keep the flat, is from the hdb branch officer. He or she will be able to take into consideration and share the most optimal solution.
