We had put up an offer to the owner's agent for a unit that we had liked. However, after one week the owner's agent called us and asked for a cheque for 1% of the offer price without even signing the LOI. She says that it is important to give this cheque before she can even put up the offer price to the seller. She insists that this is a common practice and she will return the cheque if the seller rejects the offer.Can anyone please guide me if this is indeed standard practise. It sounds a bit fishy to me.

Hi Minah,
To your question which you have just posed, i must admit that what the agent said is true. It is a standard practice all agents do.

However the correct LONG procedure safe guarding your interest should be signing the Offer to Purchase when submitting the cheque. Option to Purchase has a validity of 3 days. Should the owner rejects you offer, he will sign back on the Offer to Purchase and return back the document plus the cheque to you. If the owner accepts your offer, you will proceed to the next phase of Option to Purchase with the owner signing on it and passed back to you to go get a bank loan (Letter of Offer from bank).

It is also very important to do an ownership check to determine if the 1% cheque is issued is to the right owner. You can get back to me should you have further queries at 9438 5701  . Thank you.
