It depends on the timing. If you have yet to go through the divorce, then a part-share purchase from your spouse is not possible.

If you are doing the part-share purchase post-divorce, then it depends on whether you are already independently eligible to hold the HDB, which depends on the nature of your commercial property, age etc...

There are no restrictions preventing HDB owners from owning a commercial unit while their Minimum Occupation Period (MOP) is still ongoing. However, there are several challenges to consider:

a) Do you qualify under any eligibility scheme to proceed with the part-share purchase?
b) Are the title deeds for your properties in Malaysia strictly designated for commercial use?
c) What is the loan quantum you are eligible for, considering your current Total Debt Servicing Ratio (TDSR) and Mortgage Servicing Ratio (MSR)?
d) Lastly, is your co-owner disputing the homeownership? What details are outlined in the Court Order?

Hi,

1) Under the HDB web one can only 1 non-residential property at the time of HFE application.
2) Now, you have 2 non-residential property under your belt thus theoritical speaking you have to let go one of them before eligible to takeover the partshare.
3) Unless the HDB grant a special approval for you to own 2 non-residential property due to the nature of your business.

It will be dependant on whether you are eligible to hold on to the HDB under your individual name. If you are, chances are that you should be able to retain the HDB post divorce, if all parties are agreeable to this outcome.

Whether you can keep the HDB depends on whether you qualify to own it on your own name. If you do, and everyone agrees, retaining the flat is generally possible.

(✔2) Timing matters
If the divorce is not yet finalised, you cannot buy over your spouse’s share. Part-share transfers only come into play after the divorce is completed.

(✔3) Post-divorce assessment
After divorce, eligibility is reviewed again based on factors such as age, ownership of other property, and HDB rules before a part-share purchase is allowed.
