Hello, I am the sole owner of one commercial property and a co-owner of another commercial property in Malaysia. I currently own an HDB flat in Singapore. In the event of a divorce, if I intend to buy over my spouse’s share of the existing HDB flat, would I be eligible to do so under HDB rules?

It depends on the timing. If you have yet to go through the divorce, then a part-share purchase from your spouse is not possible.

If you are doing the part-share purchase post-divorce, then it depends on whether you are already independently eligible to hold the HDB, which depends on the nature of your commercial property, age etc...
