Can a couple purchase a resale HDB flat where one party is the sole owner (100% ownership) and the other party is listed only as an essential occupier? If so, after fulfilling the 5-year Minimum Occupation Period (MOP), can the occupier (who is not an owner of the HDB) then go on to purchase a private property under their own name?

Would this arrangement comply with HDB rules, and are there any potential implications or restrictions we should be aware of?

This is absolutely possible based on existing regulations as long as the couple fulfill all other eligibility criteria.

All owners and occupiers listed in the flat may invest in private residential property after the minimum occupation period. However, you must continue living in the flat after the purchase of the private residential property unless you have obtained HDB’s prior approval to rent it out.

As of prevailing regulations, yes the Owner-Occupier arrangement is possible for hdb purchases. After MOP of 5 years is fulfilled, both owner and occupier can both purchase the next private property no issue, just that the ABSD will come in for the owner as its his or her 2nd property, whereas no ABSD applies since it will be considered his or her first property.

The downside for owner occupier arrangement is that the occupier's income will not be recognized for loan, and CPF OA cannot be used for the purchase or future mortgage repayments. So this arrangement is more for buyers who can afford to fund the house on single income. The occupier also technically has no say on the property since he/she is not the legal owner.

Hi Sir/Mdm,

Yes this is possible under the current HDB rules and I have assisted some of my clients to structure their purchase in this manner.

In terms of restrictions, only one of you will be the owner and therefore the loan will only be assessed under a sole income and only the owner's CPF can be utilised towards the house. Both of you will also need to be comfortable with this arrangement because under the eyes of the law, there is only 1 legal owner. If your current place is under a HDB loan and you intend to take another HDB loan for the new place, the cash outlay is also higher for such a case.

1. Yes, under current rules, an Owner-Occupier setup is allowed for HDB purchases. After meeting the 5-year Minimum Occupation Period, both parties may jointly buy a private property. However, the legal owner pays Additional Buyer’s Stamp Duty (ABSD) as it’s considered a second property; the occupier does not, since it’s treated as their first.

2. A key trade-off: the occupier's income isn’t factored into loan eligibility, and their CPF cannot be used for the purchase or loan servicing. This structure suits those financially strong enough to buy using one income alone.

3. Legally, the occupier holds no ownership rights and thus has no authority over the property, limiting their control or say in decisions.

Hi,

1) This is very common in the 60/70's where the man is usually the only sole bread winner.
2) Thus, the HDB will not stop such arrangement as interest lied with the couple and not the HDB.
3) The core occupier will only need to observe the same MOP & private residential property restrictions as the owner.
4) The core occupier can buy his/her private property after meeting the MOP.
5) The IRAS will then count the local residential property under his/her belt to determine whether need to incurr ABSD.
6) The implication of such an arrangement would be only the owner's CPF OA funds can be utilized in paying the downpayment, stamp duty and servicing the mortgage.
7) Thus, when the sole owner has difficulties in servicing the mortgage with his/her account. The core occupier can only help in cash and not using the CPF.
8) This kind of arrangement is best to have when both parties have full confidence with each other. It will become extremely sticky and complicated if there is a dispute on who contribute more to the family.
