Asking on behalf of a friend.
The couple, both are divorcees have their own hdb and MOP is this year in Q1 and Q3 2022 respectively.
In the event, person A sells the flat first, can both get married?
Will getting married impact the sales of person B when it hits the MOP in Q3 2022?
Just cautious that person A will have to include the name in person B flat, by any chance adding spouse name as occupier have any impact or by adding spouse name will extend the MOP?
Or to play safe, the marriage should happen only after Person B flat has reached MOP and complete the sales?

Hi,

Based on the incomplete info shared, it is recommended to sell both HDB first before doing any marriage procedures so to avoid being caught in the scenario.

And further it is just several months away, so I guess its still a reasonable wait. It also takes time to ready the flat for sale and time to market the property and secure a buyer, hence that can commence prior to MOP being met. And all paperwork can execute the moment MOP is officially fulfilled.

Dear Sir/Mdm,

Your friends can get married without worrying about the flat. After marriage, one of them will need to add the other name under the occupier. Once HDB is notified, HDB will then require one person to sell off the flat. Since both flats are going to MOP this year in 2022, it wont be an issue to sell either after marriage. The MOP will not be extended.

Hi,

1) Number 1 priority is to follow the court order.
2) If the court order never specified, this would be unusual because the court supposes to split the shares according to what the couples agreed and submitted for approval.
3) The HDB would follow the court order without hesitation otherwise it would be violating the state law which I doubt they are prepared to challenge the court order.
4) The HDB would allow the couple to sell their HDB flat in the open market if this is specified in the court order even before MOP.
5) If both A & B cases are to keep the HDB flat by A & B, then either A or B has to let go of their HDB flat in the open market after married.
6) They have the option of selling before or after their marriage.
7) The advantage of selling it before their marriage is they will not be mentally stressed by the 6 months period given by the HDB if they sell it after their marriage.
