It really depends on what has been agreed upon between you and your agent.

In most cases of early termination of leases (or break lease), the tenant should bare the pro-rated amount of the broker's fees besides any other penalties that may be imposed by landlord.

Hi TATA,

In usual cases for break lease, tenants will need to pay back to the landlord the commissions paid to the agent on a pro-rated basis where it is usually indicated in the tenancy agreement, however, there are also many cases where landlords allow the tenants to look for someone else to takeover lease subjected to landlord's approval.

    There is a clause regarding early termination, which is conditioned by finding another tenant to take the lease. Furthermore, the landlord accepted that solution. In that case, is the landlord allowed to ask me to pay agent fees ?

    Since there is no early termination or replacement clause in the tenancy agreement, landlord does not need to accept you to look for a replacement tenant even if you have a genuine reason to terminate your agreement early. In fact, the landlord even reserve the right to sue the tenant for the balance amount of rental that has not been consumed, for example if you have signed a 12 months lease but only stayed for 6 months, landlord can claim you for the balance 6 months that has not been consumed.

    Hello,

    I had to break my lease early for work reason. However I found another tenant to take over the lease right after I leave. Is my agent (the renting company) allowed to ask me to pay agent fees (100$/month unfulfilled) ?

    If there is no clause for premature termination of lease, then there should be no breaking of lease allowed, therefore the tenant need to pay whatever amount of rental that is not fulfilled in the tenancy agreement, but landlord will need to enforce this through proper legal channels. Commission paid is usually non-refundable unless you have an agreement for this with agent. If agent has failed in his or her duty as a salesperson to you, then you can officially lodge a complain with the authorities.

In typical situations, when a tenant breaks a lease early, they are usually required to reimburse the landlord for the pro-rated portion of the agent’s commission. This provision is typically outlined in the tenancy agreement.
