As a seller waiting for completion date, are we liable to withdraw from HIP if we had opted in and the buyer wants to withdraw from HIP ? The buyer keeps harassing us through the agent and the HIP officers. We must be free to even help them as the HIP officer operates during work hours and we are working during that time. We did not sign any agreement to assist the buyer to opt out. I feel this should be done out of a kind gesture and the seller must have time for this.

Is withdrawal from HIP a condition put forth by the buyer when they made an offer? If you have agreed to it on such offer, of course then there will be obligations to do so to ensure that the agreed conditions is delivered. Otherwise there should be no obligations on the seller's part to withdraw, but that again, there can also be complications in buyers withdrawing from the purchase before completion leaving you in limbo over the post sale plans. Of course there is an obligation to complete the transaction but to enforce such obligations, it means you need to take legal actions against the buyers too. I have not encountered such incidents before and I do not know how complicated it is to withdraw the opt-in on HIP, but weighing out the situation, perhaps it could somehow ease the tensions to address this if it is a matter of liaison through some emails or phone calls during the meal breaks or tea breaks during office hours?

Sometimes legal entitlement is 1 thing, but the enforcement of it can be even more stressful and not practical.

Hi,

1) The first thing you must be clear whether this was an agreement (this can be verbal or written) regarding this HIP thingy before issuing the OTP.
2) If there was no agreement between yourself and the buyer then you can leave the buyer to liaise with the HIP officer directly.
3) In order to opt-out from the HIP after the announcement of the commencement of the program, the unit must fulfill certain conditions before it is possible.
4) If the HIP program has not gone through the balloting then it will be another issue.
5) The HIP officer will need to enter the unit to conduct a water test and whatever is necessary to assess and ensure the unit meets the opt-out condition.
6) If there is an agreement between yourself and the buyer then you have to do your best to assist in the testing so that your selling plan can carry out.
