A HDB owner wants to buy a private condo & sell the HDB flat within 6 months of his purchase (ie. he will be holding 2 residential properties during the interim period; but ultimately will own only 1 residential property upon sale of HDB. In this case, he needs to pay 1) BSD or 2) ABSD on the purchase of the private property ?

Hi,

I assume your MOP of 5 years for the HDB is fulfilled. BSD of approx 3% - 4% on the purchase is definitely applicable for any property purchase.

If a buyer can be secured for the HDB and the exercise date of the OTP of the HDB be before you purchase the private property, it would be considered you have sold off the HDB first and zero property count at point of purchase, hence ABSD will not be applicable. However it does come with the risks as the timeline is quite tight.

Alternatively, if this is a singaporean married couple household and you can sell off the matrimonial HDB within 6 months after purchase of the next matrimonial private property, it may be possible to apply for ABSD refund (do note you still have to pay ABSD first) upon sale of the HDB.

Hi,

1) Whether sell first buy later or vice versa is feasible. I'll assume this is a matrimonial home upgrading.
(a) Sell first buy later:
(i) Not subject to ABSD (timing of procedures is critical in this scenario)

(b) Buy first sell later
(i) incurred ABSD during buying.
(ii) Apply for ABSD remission later after selling the HDB flat.

2) In order to shorten the interim period, you can offer for an OTP (private) upon receiving the exercised OTP (HDB) from the buyer.
3) So by the time you exercise the OTP (private) and submit your exercised OTP to the lawyer. The lawyer will present this to IRAS as proof of not owning any residential property at the point of purchase, and therefore not subject to any ABSD.

4) BSD is mandatory for all property purchases. It is the same rate applied to buyers with any residence status.

Hi,

BSD is payable for all property purchases, regardless of timing of the purchase.

ABSD is payable if the Buyer owns more than 1 property at the time of the purchase. ABSD is also payable if he's not a Singapore Citizen.

If he's a Singapore Citizen, he is able to get ABSD refund if the private condo is co-purchased with his Wife as their first matrimonial home, and their HDB flat is sold within 6 months upon the condo purchase.

Do take note that apart from ABSD, LTV and TDSR is also taken into consideration if his HDB is still under loan. He will not be able to get maximum 75% loan for his condo purchase if his HDB flat is still under loan. His loan is also subjected to TDSR requirements.
