1 )Do I need a lawyer to apply for ABSD refund? How long does it take before the funds are refunded back from IRAS?

2 ) My wife and I co own a HDB and we are in the midst of purchasing a private property. My wife co owns a private property with her family and she has since relinquished her share BEFORE we exercised the OTP for this private property that we both intend to buy. We are in the intention to sell the HDB as well within the next 6 months. Are we still eligible for ABSD refund? We are both Singapore citizens.

Remission need to be informed to lawyer upfront while doing the property transaction if not. You are not eligible for ABSD remission upon transaction completed.

Hi Kesh,

You will be eligible for an ABSD refund as you are purchasing the private property as a married couple as long as you dispose off your HBD within 6 months from the date of purchase of the condo. Please refer to this link for more info:

As long as you and your wife dispose all interests in other properties and also notify your lawyer beforehand, you'd be both eligible and could get the ABSD refund.
