What is the procedure to rent a retail? Should owner or tenant apply the change trade/use for the shop? Who should pay for the fee? If never complete the number of years of lease does the tenant need to pay for the agent fee and also must find another tenant to take over?

Dear Kevin,

As the rental is considered a private contract, it will be up to the agreement between the landlord and tenant to see who pays for what fees, however, in most cases, the application on change of use is usually applied by the tenant. In the event that tenant is unable to see out the duration of contract, the usual arrangement is for the tenant to look for replacement tenant at their own costs. Nevertheless, as I have highlighted, these are private terms and conditions to be agreed between the landlord and tenant, and can vary for different cases.
