Subsale typically refers to the sale of an under construction condo before TOP and CSC stage is obtained, and you are buying from the first owner instead of the developer. Buying from developer constitutes New Sale. Yes it is legal and is common for buyers who do not want to wait and yet want to get a new property to move in quickly. Subsale typically is priced higher than developer units as the first owner will factor in his/her interest costs, stamp duties and a profit margin before he/she will consider to sell.

Its similar to buying private resale where you need to pay 5% option + exercise fee, and usually law firm cost will be higher as more paperwork is involved between first owner, developer and you. Developer have to issue new s&p to you.

Subsale happens when a unit is sold before CSC is obtained from the 1st owner who purchased from developer to the next owner. It is legal to do so and price is based on negotiation between the seller and buyer.
