What are the Buyers rights? What are the implications on the Buyers if they cancel the purchase of a Resale HDB flat prior to 2nd appt with the HDB? This is because they found out that the house is infested with termites on their 2nd visit to prepare for early reno. Now they wished to cancel the purchase due to health and safety reasons as they have baby and young children around. Buyers only view the house once when they signed the OTP and was told to pay the exercise fee. They were not inform that they can actually go and have a look at the house again before the Option expiry date and confirm on their purchase.

Since 2nd appointment is due soon, it is already legal binding on both parties to be committed to this sale. Unless both parties agree to back out, I do not see how the buyer can withdraw from this transaction just like that. Unless there is a case of misrepresentation involved leading up to the buyer putting in the offer and exercising the option to purchase, perhaps there maybe a case to bring up.
