We went for an open house this morning and we liked the unit very much. While we are doing the viewing, another buyer wrote the cheque to offer. We immediately offered higher right after the viewing. But we were told by the agent that she is not accepting any more offer as she has accepted the other lower offer. We felt that was being dishonest as she didn't even give us a chance. It is also unfair for the owner as they didn't get a chance to decide to take the higher offer. How do we lodge a complaint against the agent? I understand from my buyer agent that she is going overseas and I feel that she just want to close a quick deal.

Hi, I can understand how you are feeling right now. And if you do feel injustified and wish to lodge a complaint, you may do so via CEA website and contact the person in charge.

Dear buyer,

I am not exactly sure what the whole situation is and what exact happened after the other buyer offered, but once that offer was made and accepted, even if you come in with a higher offer after viewing, it will still mean that you have missed the property. Sometimes, it is not the highest offer that secures but the earliest acceptable offer that secures unit. A minute or even 30 seconds can make a difference. Just put yourself in the buyer who made the earlier offer shoes, how would you feel if the seller who has already accepted your offer returns you the cheque you have offered because someone else offered higher?

    Well, the owner was not present during the open house. We could clearly see a couple issuing a cheque while we are in the house. Wouldn't an ethical agent accept both the cheques and present to the owners to let them choose? My point is how could an agent make a decision to accept an offer without informing the owner and chose to accept a deal which she doesn't have to co-broke (we went there with our agent while she doesn't have to co-broke if she choose the other buyers ? Obviously she is acting in her self interest rather than owner's. I do feel that agents like her shouldn't be in the industry. When I confronted her that she is being dishonest, she told me that 'Honesty is a perception'. Anyway we have managed to submit our offer, and just wish the owners will know what she has done.

When the seller accepted the offer, the decision will passed to the buyer within 21 days. You still have a little chance if the buyer don't exercise the OTP. I suggest you move on to view other unit with another comfortable agent. Please allow me to assist you.

Dear buyer,

I assume that your are referring to purchasing a private property. I am unsure how did you derive to a conclusion that agent was the one to make a decision to accept an offer without informing the owner. Basically, an offer can be made via phonecall or SMS, and the seller could decide within a minute to accept or not before paperworks are done. All these can happen within a minute of phone call. Of course all the above are based on assumptions. If you are dead sure about her not taking the best interest in representing the seller, you can escalate this matter further, nevertheless, if her paymaster is satisfied with her service, I am unsure how the authorities will deal with this matter. I strongly encourage you to move on from this episode and look for another option. Do you agree that the whole process of finding a dream home should be a happy one instead of dealing with such unpleasantness?
