We bought an EC and TOP just 8 months ago. Now we are in bad terms and wanted to divorce, can you advise what will happen to the property? Will we be able to sell it or get back our CPF? Or we have to pay for penalty? Who do we contact? HDB or Developer?

Good afternoon Wendy,

I am sorry to hear that. Probably you should approach HDB first and see how you can proceed from there. EC is under the scope of HDB and have to adhere to 5 years MOP before you can dispose off or rent.

Based on HDB regulations, you most likely have to apply for permission to sell within MOP.

At the same time, you should probably speak to a lawyer and obtain his advice since you might want to divorce.

Evening Wendy,

New EC is are regulated by HDB prior MOP. With your case, you will need to approach HDB for special approval to sell upon getting the court order for divorce. As for the penalty, you will need to pay the SSD and possibly the bank charges for early repayment of mortgage loan.
