We are Sporeans. We have a signed TA w/o a termination clause. We were given misrepresentation of information b4 we take up the unit. Due to the misleading information we have signed a 42 months personal lease. The unit is unbearable with major construction affecting us in many ways. Our agent does not wish to own up and stop attending to us. The landlord & their agent seem like buying time not responsive. We requested for break lease. Initially landlord & their agent said we just need to reimburse landlord pro-rata commission paid to agency for the unfulfilled terms & the notice of termination is 2 months. We agreed & went ahead. Later,they turned back their words & demanded we must bear the loss of any rental loss during transition period between us & the new tenant. They will deduct fr security deposit. We are not happy to do so as they were not upfront.they know we r after evidence& stop communicatg. CEA cant help w/o evidence? Complain to agency helps?Can landlord demand whatever.

Dear tenant,

The situation is quite straightforward. If there is no evidence supporting your claims, I do not think there is any form of recourse you can get out from the situation. Especially with a tenancy agreement signed and stamped, this document is a legal document where landlord can claim his rights against you in the court. It is in your best interest to work out a solution in this scenario with the landlord in terms of seeking a replacement tenant probably.

The term of misrepresentation comes in which manner? Indicating that you are signing a lease of 3.5 years was not made clear to you or the non existence of diplomatic clause or the unsuitable environment around you?
I'm sure you should be aware of the lease period as you will be paying the security deposit according to period of lease. As for diplomatic clause, not all landlord allow that though it's good to have for tenants. As for the environment, you should have viewed the unit and environment prior taking the unit. Plans for construction, road work and modifications are not within our control. Unless you can provide concrete proof for your claim, it's tough to go around it.
