Good afternoon,

If you are a legally married couple, unfortunately both names will have to be included for the resale HDB purchase as HDB requires both of your names to form a family nucleus so as to be eligible. This means the EC will still have to be sold, which may not be what you intended originally.

Alternatively you can consider to decouple and purchase a smaller private property under 1 individual name instead. This will help you to achieve the goal to have 2 properties in the portfolio, one for own stay one for rental.

Are both of you married? If yes, then you are able to decouple but unable to purchase a HDB resale flat unless you intend to sell the EC after purchasing the resale HDB. This is a rule by HDB since both of you are married couple.

Hi,
You can decouple and it takes about 6 weeks. However, you or your spouse cannot buy an HDB flat because both your names has to be in the application either as owner or occupier. You cannot do that if you own a private property. EC is private after 5 years and singles can buy them just like a private property. I would suggest you or your spouse buy another EC as an investment.

Yes decoupling is possible after the EC MOP and a lot of my clients did exactly that. The cost involves are the stamp duty for the part purchase and legal fees of about 6k. However is it not possible for the outgoing party to purchase a HDB flat as buyers for HDB flat are required to form a family nucleus to buy and both husband and wife names will need to be included either as owner or essential occupier.

Hi,

1) Yes, you may do decoupling once you have met the MOP of the EC.
2) No, you are not allowed to buy an HDB resale flat alone if you are married.
3) A married couple is considered a single entity when come to buying an HDB flat. Both names have to be inserted for the purchase application.
4) Your cost is mainly on the tax and legal fees, so it is dependent on the value of the shares selling for the buyer stamp duty. Whereas the legal fees are for buying and selling so it is around $5~$7k depending on the law firm engaged.
5) The timing of completion is around 3 months for properties with an outstanding loan, and 2 months for properties without any outstanding loans.
6) If both owners are not married couples, but are joint singles then the outgoing owner can buy an HDB flat 4-rm and smaller after selling the EC shares.
