Hi, this is a tricky situation where in black and white TA you signed the agreement to accept the condition of the rental unit. However since it is in written in whatsapp of your conditions, you might be in the right . You can choose to not pay the security deposit to the landlord , whereas the landlord also has the right to take you to small claims tribunal , in which case the judge will be the one to decide who is in the right . In future if you want to avoid such situation, you can consider approaching a agent to assist in your property transactions .

If you are currently on or planning to go on a property journey be it in selling/buying/renting/investing, I am here to assist. Please reach out to me for assistance.

I don't see any reasons for the agent to claim when he or she should not have even proceeded to arrange for the Tenancy Agreement without any deposit. There is no offer to talk about when there isn't any considerations (deposit) made, this is what I have learnt before I became a practising RES, unless I was taught wrongly. To claim any compensation legally, the agent needs to file a proper legal claim, either through the lawyer or through small claims tribunal. Read More

Based on what you described, you likely have a strong case to avoid paying any compensation to the agent. Here's a breakdown of the situation:

Broken Agreement: The landlord failing to meet the pre-requisite conditions you outlined in writing constitutes a breach of the Tenancy Agreement (TA).

No Legal Obligation: Since you hadn't paid any security deposit or stamp duty, and you withdrew before finalizing the TA, you likely don't have a legal obligation to compensate the agent.

Here's how you can respond to the agent:

Politely Decline: Thank the agent for their time but reiterate your decision to withdraw due to the broken agreement.

State the Reason: Briefly mention that the landlord's failure to fulfill the pre-requisite conditions as agreed upon in writing is the reason for your withdrawal.

Refer to No Payment: Highlight that since there was no signed TA, security deposit payment, or stamp duty, there's no legal basis for compensation.

if agent still insist on BEING UNREASONABLE > U MAY PRINTSCREEN ALL EVIDENCE> AND COMPLAIN BOTH TO AGENT AGENCY AND CEA ABOUT THIS > THEY CANNOT " ANYHOW BULLY
" you on this ( personal opinion)>> HOW TO COMPLAIN ? > PM ME > I share more with you further ,... first of all > agent license number is not difficult to get from internet in the first place ,...
