Hi Ms Constance,

I am assuming you are speaking in the position of a Landlord.

WIthout consideration (deposit paid), the contract is not formally being entered.

Thus the tenants have an opportunity to back out from the Agreement. The next step is to collect the deposits as soon as possible and also pay stamp duty (within 14 days) from the date of the TA.

Good faith deposit SHOULD be paid/collected on signing LOI.

Security deposits SHOULD be paid/collected on signing of TA.

Hi Constance,

Like what Steven has indicated, it should not have reached this stage you have described without the deposits paid. If you examine the tenancy agreement, it usually will indicate that deposit should have been received upon signing the documents.

Please check back with your appointed salesperson on this aspect as this should not have happened and I will never allow such incident to happen to my landlords.
