OTP and 1st Appt is done. The completion is on 12th Apr 13. We have a common conveyancing lawyer. He is supposed to sign the Transfer documents by 5th Apr 13 (I have signed). He may not sign. Divorce order is very simply worded: "The Parties matrimonial flat at Blk xxx, xxxxx is to be sold in the open market and the net proceeds of sale after repayment of outstanding loan and costs and expenses in the proportion of xx% to the Plaintiff and xx% to the Defendant." After selling of the flat he has to pay me amt of more than 60k for arrears (Enforcement Court Orders), this could be the reason for his reluctance to complete the sale. I know that the buyers can sue us for specific performance damages should the sale be delayed. Since it is my EX that's deliberately stalling or scuttle the deal,how can I protect my interest? Can I apply to the Court for a Registrar to sign on his behalf? How long does this process take?
