My wife is a owner of HDB and I am an essential occupant. After MOP, can my wife buy private property without selling the current HDB? Similarly, as an essential occupant, can I buy a private property without selling the current HDB?

Good afternoon Jimmy,

Assuming 5 years MOP are met and both of you are citizens, yes you can purchase 2nd residential property without selling the hdb. As of current regulation, it would be more ideal to purchase under your own name (the occupant's name) as the upfront costs are lower since you are not considered to have any property count.

Hi Jimmy

Yes, your wife can buy a private property after the MOP. There will be an ABSD if she (SC) holds on to the HDB.

As for you, you may buy a private property after the MOP.

Hi Jimmy,

If your wife is a Singaporean, she will be able to purchase a 2nd property (private condo) without the need to sell off the HDB. However, do note that she will be subjected to the 12% of Additional Buyer Stamp Duty as it will be her 2nd property.

It will be wiser to buy under your name instead because as an Essential Occupier, your property count is 0 and therefore you will not be liable for any ABSD thereby the 12% savings in tax.

I had just closed a case like this yesterday, with the Wife as the sole purchaser of the HDB flat and the Husband the essential occupier.

Upon fulfilling the 5 years MOP, both the Husband and the Wife will be able to purchase another private property without having to sell off the HDB flat. The only difference is that the Wife will be subjected to an Additional Buyer Stamp Duty (ABSD), currently set at 12% for Singaporeans getting their second property. If the condo purchase is done under the Husband's sole name, then no ABSD is applicable, thereby saving up to 12% of additional duties.

The answer is yes,both of you can purchase 2nd private property without disposing the HDB unit. However, the difference is that your wife as a owner of the HDB unit will be subjected to Additional Buyer Stamp Duty of 12% while you (occupant) are not. That is why it is more ideal to buy 2nd private property under your name
