My tenant told me only tenancy agreement which involve agent need to pay stamp duty. If the agreement is between tenant n landlord, there's no need for stamp duty. Is that true? That's not my understanding. My understanding is stamp duty is to make the document legal. Please help.

Hi,

Actually stamp duty is meant to put the agreement as a legal document rather than whether a third party is involved.

It is an offence to use a tenancy agreement if its stamp duty has not been made. Actions can be taken by the authorities (and the landlord) against tenants who fail to pay on time or completely ignore paying it altogether.

You have to pay the stamp duty within 14 days from the date you sign the TA.

You may pay stamp duty at IRAS website or at IRAS, it is only 4% of the total TA amount, e.g. $1k rental for 12 months is $48.

Hi, it is illegal for any TA that is without stamp duty. Even a room rental needs stamp duty too.
