My question is regarding ABSD. Being a Malaysian PR, I need to pay 5% ABSD for a condo I'm interested in purchasing in the Thomson area. My parents are Singaporean. Can I buy the property under my mother's name solely and not have to bear the extra 5% ABSD? What if I buy the property jointly under my and my mother's name, am I still required to pay ABSD?

Hi,

Yes you can purchase under your parent's sole name. If its her 1st residential property, yes ABSD will not be applicable. If its jointly purchased with your name and hers, IRAS will take the higher ABSD rate of the two purchasers, ie. 5% ABSD is still applicable for this purchase, if both of you currently own zero residential properties.

Dear Sir/Mdm,

If you were to purchase under your mum's name alone and she does not have any residential property in Singapore, then ABSD will not be applicable. However, the challenge will be the financing aspect of the property. Only her sole income and age will be taken into consideration for the loan assessment. This option is feasible provided that her income and age is able to support the loan that you are seeking.

If you purchase together with your mum, although she is a Singaporean, you will still be taxed on the higher tier ABSD which is 5%.

Hi,

If your Mother does not own any residential property, she will not incur ABSD for her first residential property purchase. Else if she currently owns a residential property, for her second residential property, she will be liable for ABSD of 12%. If she's taking a loan for the purchase, she will also need to be able to support the loan amount based on TDSR and LTV requirements.

If she jointly purchase it with you, the higher ABSD rate will apply. Hence, either 5% if she doesn't currently own a residential property, or 12% if she currently owns a residential property.

Depending on you and your Mother's financial, there may be other ways you can explore.
