My parents have a landed property together, financed by both their CPF monies and cash from both.

They are going through a divorce, my father is willing to leave the property to my mother as goodwill.

Some questions:
1. How can the property be transferred to my mother and if any payment / return of money is required?

2. How long will it take for my dad to be eligible to buy his own HDB flat? Is there a minimum time period that he has to wait before being able to buy a HDB resale?

Hi there,

Your mother would possibly have to pay BSD for the market value of the portion being transferred to her, and for your Dad, he can buy a HDB resale right away.

Good afternoon,

Usually transfer of ownership will usually involve refund of CPF OA funds for instance from your mom to dad in cash.

Stamp duties will be payable to IRAS based on the percentage of ownership transferred from your dad to your mom.

Lastly if there's any outstanding loan, your mom must have the financial capability to take on the loan herself.

In addition in fact your dad can purchase a resale HDB right now under single singapore citizen scheme if he is eligible.

He just need to dispose his interest in the landed within 6 months from completion date will do.

Hi

For your dad to transfer his share of the landed property to your mum , buyer stamp duty BSD is payable to IRAS , accordingly based on the value or portion being transfered , at a rate of 3% minus $5400 .
Example a $4million landed property based on 50/50% ownership , BSD of $2million , BSD payable is $54 600 .

In addition , any cpf that your dad has contributed to the landed purchase , need to be transfered back to his cpf account .

Alternatively your parents can sell their landed and each buy their own resale hdb after they are divorced .

Hi,

1. If the landed property is fully paid up, your dad may transfer the property by way of gift to your mum. However, do note that standard stamp duty is applicable on the value of the property share transferred. The CPF plus accrued interests that your dad used have to be return to his CPF account.

2. There is no minimum period to observe to buy a resale HDB. He can buy the HDB but have to complete the transfer of share in the landed property to your mum within 6 months from the completion of his HDB purchase.
