My brother is looking to buy a resale flat with his fiancée who is currently still holding a student pass, she will have to fulfil her employment with our govt for a 3 year bond also. Please advise if it is possible for them to just buy a resale flat or they will need to wait until she get the PR before they can commit?

Hi Sir/Mdm,

He may be eligible to purchase under the Non-Citizen Spouse Scheme upon their marriage.

If he is 21 years old or above -
His spouse must have a valid Long Term Visit Pass or Work Pass at the time he submit his application to buy a resale flat. The pass must have a validity period of at least 6 months from the date of issue.

If he is 35 years old or above -
His spouse must have a valid Visit Pass or Work Pass at the time he submit his application to buy a resale flat. The pass need not have a validity period of 6 months from the date of issue.

His non-citizen spouse must be listed in the application as an occupier.

Your brother will be able to purchase a resale flat under the Non-Citizen Spouse Scheme.

Do take note that only his income will be taken in for assessment, as his spouse will only be the essential occupier, not the co-owner.

Hi,

1) With your brother's spouse still holding a student pass is not able to fulfill the minimum criteria under the Non-Citizen Spouse scheme.
2) Work pass is one of the criteria, and dependent on your brother's current age, either Long term Visit pass (>21, 35) at the time of application submission.
3) If your brother currently >35 years old. He may buy under his name only since not married; under the Single Citizen scheme.
4) No difference in grant amount comparing Single Citizen and Non-Citizen Spouse scheme.
5) Financially is the same as well. Your brother's spouse cannot be listed as the owner even buy under the Non-Citizen Spouse Scheme. Only she will be listed as an essential occupier instead of just an occupier.
As an essential occupier, she must agree if decided to sell the flat at a later time. Although she doesn't need to sign anything. Since she is the legal spouse, HDB will need her consent before process the paperwork.

Hi

If your brother have not turned 35 yet, he can buy a resale only after official marriage with his fiance who is a foreigner and eligible for foreign citizen spouse scheme. Your brother is also eligible for singles grant although he have not reached 35. However do note that your brother will be the sole owner of the house and his spouse must be named as occupier as HDB regulation states only Singapore Citizen or SPR can be owner of HDB. If your brother is above 35, he can proceed to purchase a resale alone and still eligible for the singles grant. I am specialised in HDB transaction.
