Me and my wife purchased a EC a few years back and it is going to TOP soon. However, we have decided to divorce. I dont mind letting my wife take over the EC. But can we do so? If we were to divorce, willing hdb or the developer take back the EC? If my wife can take over the EC, will I be able to get back my money n cpf I paid for the EC?

Hi Thomas, I'm afraid none of you could take over the EC unit when it has TOP. As under HDB ruling, a single local is not eligible to buy a new EC.

Dear sir,

I am not a subject matter expert in this scenario but in my very own opinion, in order to take over the unit, the party who is going to take over needs to fulfill the necessary criteria in terms of family nucleus as well as have the necessary financial capacity to do so. Once this has been addressed, you may wish to call up the developer and check on what is the feasibility to proceed.

Good day Thomas,

I previously had a client whom had the same situation as you do. On a direct note, should you or your ex-spouse re-marries and decides to take over the flat with sufficient financial capabilities, the developer might grant an exception on this. Nevertheless, you should wait for the final judgement as it shall determine what must be done eventually. You may also wish to seek legal advice on this matter.

Hi Thomas, You will have to give up the new EC if you can't produce the marriage cert. within 6 mths after taking key. Sell it to be clean, so all finances will be returned to you.
