In July 2021 I renewed the TA with my tenant at a lower rent due to the pandemic for another 2 years. Now market rent has increased by 40%. Can I increase the rent to reflect current market pricing? If not, can I terminate TA before it’s expiry date?

Dear sir/mdm,

I honestly think that nobody could have predicted the boom in the rental market during the pandemic. Anyway, you will need to have clauses within the renewed TA that allows you to adjust the rent during the rental period or terminate the lease prematurely in order to do so. Otherwise you cannot do any of the above. I believe many landlords who entered into long lease arrangement back then may have similar encounters. Similarly, if rental did not rise but decrease by 40%, tenants will also have similar questions to whether can they decrease the rent further or terminate the lease prematurely to look for lower rental.
