You will need to examine your tenancy agreement and service fees agreement properly because all the terms and conditions or implied terms and conditions are within.

Is your tenant allowed to terminate the lease prematurely?

In all cases I have handled, service fees paid are non-refundable, but tenant will need to reimburse the landlord on a pro rated basis, the service fees landlord has paid, for the balance period where lease will be unfulfilled.

Depending on agreement with the tenant, landlord can offset this amount from the security deposit to be returned to the tenant.

Hi,

Your tenant is going to break the contract, I'm not sure why are you penalizing your agent on this when it's not his fault.

Anyway, all service fees paid are not refundable, and you have no right to claim refund from the agencies either.

You should instead penalize the tenant for breaking the lease. According to the terms of the TA, you can actually confiscate the entire deposit and claim further for the loss of income for the remaining duration of the lease.

Hi, if there is no exit clause in the TA, you have the right to forfeit the full deposit.
