If one of the 3 tenants in common owning the property has passed away, can the other 2 still rent out the property without the approval of the executor of the estate? but of course continue to give the estate its share of the rental?

Good day,

Always do the right thing and the right thing to do here is to seek the approval of all relevant parties first.

The implication of not doing so could be as serious as Fraudulent Misrepresentation and any contract that arises from it, in this case the Tenancy Agreement could be rescinded. It could also potentially leads to expensive and lengthy legal proceedings should the executor of the estate objects to the rental for some reason or another.
