If my non-exclusive agent's co-broke agent, approach me separately after the viewing of my unit, to say his buyer ask him to make an offer for my unit, is it illegal for me to deal directly with my non-exclusive agent's co-broke agent instead of going through my non-exclusive agent? Any penalty and do I have to also pay my non-exclusive agent the commission and also pay commission to his co-broke agent?

Hi, it depends on whether you want to go ahead with this case as the buyer agent has got an integrity issue. There is nothing wrong on your part and you can choose not to pay any commission to the buyer agent. Pls feel free to let me know if you have got more query relating to this.

I strongly disagree with what Aaron has mentioned that there is nothing wrong on your part. Aaron has also highlighted on the integrity issue, and by dealing with the undercutting salesperson without the non-exclusive salesperson, your integrity is also being questioned. Technically, as long as your non-exclusive salesperson can proof that he is the effective cause of sale, he can seek for commissions to be paid to him and I always believe that a salesperson has done what they should in showing the property and generating a right offer, therefore he or she should be duly paid. You should get in touch with this salesperson immediately and inform him that the buyer's agent is performing unethically and you reserve the rights to write into their respective agency to get the ethical portion of their salesperson right.

(Unless if the buyer's salesperson has tried to make an offer through your salesperson but he/she did not want to work on this cobroke offer, then the scenario will be different.)

The cobroke agent is unethical.
If this deal goes thru WITHOUT the non exclusive agent, he can report to CEA and the cobroke agent may be penalized.

As the seller ( yourself), CEA MAY penalize you as well even though you did not sign exclusive with the agent.

It is an issue of Integrity and Conscience. Read More
