If my landlord does not repair a broken toilet for over 4 months, is there any recourse to claim back rent given unsanitary/unsafe living conditions (only 1 toilet in apartment)?

Additionally, we would like to leave our apartment early, but do not have a diplomatic clause, and felt that this situation might be an amicable way to leave early for both parties, but the landlord has denied. Do we have any other recourse to vacate early given he did not address the toilet issue in a timely manner?

Morning,

I would believe that your representing agent would have assisted you on bringing the request forward to your landlord. I would also believe that your agent might be your best witness and mediator for the issue since the TA should be signed in their presence.

    Thanks for your help. The representing agent was the only mediator (we cannot contact our landlord directly) after roughly 100 emails, they finally fixed the issue but we went more than 6 weeks without a working toilet. We would have terminated the lease during this time but were worried about finding an alternative housing. Is there any recourse now that the issue has been resolved or can we still claim refund for disrepair?
Hi Matt,

In addition to what Mike has indicated, this is 1 reason why a salesperson can come in to assist in any conflicts arising from a tenancy as we do not know when such incident will arise. In cases where you do not have a representative either way, you will probably need to look into the contents of the tenancy agreement to seek solutions on how you can get out of this sticky situation, especially if landlord and yourself cannot see eye to eye on the situation.
