Hi, technically yes the seller can sue you. But I believe not all the sellers are so unreasonable to an extend of not listening if you could provide concrete proof that you really could not go ahead to proceed on with this deal.

Technically yes. Once the buyer choose to exercise the OTP, it's deem that they have done the necessary to secure a loan on the financing aspect. Furthermore, the completed OTP is considered as a legal binding contract. The seller have the right to request for specific performance, compensation on lose in difference on the remarketing of the unit, etc. Alternatively, you can consult your agent for further assistance.
