I signed a 2+3 year commercial tenancy agreement with a landlord via an agent. We've been operating for a year now. Suddenly the authorities came to check and say the unit is approved for residential use, not commercial. We need to pay a huge levy to change the use from residential to commercial.

I've invested alot of time and money in the space. I'm at a loss of what to do.

What can I do in this case? I definitely want to continue operations but the levy is too huge for me to bear as a new business, and totally unexpected because the tenancy we signed stated very clearly it's a commercial unit.

Or what recourse do I have against the landlord and agent? That's the last thing I want, but if it comes that that, what recourse do I have?

Hi, it really depends on what was being committed to you before signing the tenancy agreement (if there's any black and white). Have you tried discussing this with your agent or landlord?
Without knowing too much details, it will be difficult to comment further.
