Hi,

This is a problem leading to another.
First of all, it is illegal to sublet. Second, lots of tenant does not know that this is illegal.

The main problem is there are so-called "2nd landlord" took the deposit and rental and went disappear after subletting. And landlord will suffer from the damage caused.

That was why it is important to ensure the essential clauses are available in the tenancy agreement.

There are 2 parts in a good tenancy agreement that prevent this from happening:
(1) Name and NRIC/FIN/Passport number has to fill in on the tenancy agreement, showing landlord and tenant aware that only people listed are allowed to stay.
(2) A clause stating "no subletting" is allowed.

Hi Anonymous,

If it was not with your consent, than it could be illegal with the tenant infringing one of the covenants.

You may like to remind your tenant to adhere to this as it could lead to a breach of tenancy Agreement with severe consequences.
