I saw a Condo unit that i am interested in. However i called up the agent but was told that the seller is selling the unit with 1 year tenancy left. Was told that the unit was not suitable for me by the agent. I have to sell my HDB so as to move into Condo unit to avoid the 7% ABSD. I am curious why cant the seller of the condo unit terminate the tenancy in advance for me to move in if i am keen to buy..

Hi,

Terminating a tenancy agreement involves a lot of hassle and can be subjected to various penalties or even potential law suit. If things go awry, the sale can't be completed and you can potentially be left in limbo. I'm sure you want to purchase with a peace of mind as well.

Perhaps you might want to consider other units if there's no breakthrough with that unit. May I have more info and requirements about your plans so to make better recommendations? Thanks and look forward to value-add to your housing plans.

Good evening buyer,

I assume that you are looking to purchase an unit for own occupation.

Normally for unit selling with tenancy, you have to purchase it with tenancy.

Usually sellers wont terminate the tenancy agreement because they will subject to penalty according to TA.

Some standard clauses will be:

1) pro rated commission to tenants for what they had paid to their representative
2) might have to pay security deposit to tenant for breach of contract etc

Thats why you will seldom encounter sellers that will terminate lease for the sake of buyers.

You might want to consider units selling with vacant possession (without tenancy).

Hi friend,

As explained by fellow agents, all tenancies are legally bound.

Owners cannot simply terminate the lease as and when they choose, same goes to the tenants.

Since it is a condo, this is just but one of the unit.
Since it is to be sold with tenancy, why dont you just look for another within the same condo project that is not tenanted ?

Hi Sir/Mdm,

If there are no early termination option in the tenancy agreement, the landlord will not be able to terminate the lease prematurely.

For your case, it will be ideal to purchase a unit which is selling vacant or a new project that is nearing TOP. For the sale of your HDB, it will be recommended to request for an extension of stay to your buyers so that you will have more than sufficient time to renovate the new place and move your items over.

Hi buyer,

Why don't you buy the unit and terminate the tenancy yourself as the legal owner? With the penalties involved, that's not too wise an option for the current owner to do so, with no legal obligations by you should the deal not go through.
