I like to know whether there is such a law in Singapore that says that anyone who stays in a flat or a house that belongs to another person, and upkeeps the place for a prolong period, the flat or the house will eventually be own by him in the sight of the law. If there is such a law,please explain it to me in details. Thank you.

Afternoon Christine,

Yes, there's such law and ruling but various conditions applies. If there's no break in the period of stay and the owner is not staying at the premises, any legal documents have being drafted in reference to the intention and the landlords purpose of purchase plus your purpose of staying in the premises, etc, will determine and factor to the ownership issue.

Dear Christine,

Under the Conveyancing and Law of Property Act of 1994, all conveyances of real estate need to be documented in writing to be effective.

The law of adverse possession has since been abolished, thus it is no longer possible to claim ownership of property via this route.

There are however exceptions where the situation you outlined might occur. For instance, if a spouse were to acquire a property in his sole name but during the marriage the wife were to contribute towards the upkeep, maintainance and enhancement of this property, the wife might be entitled to a share of the property in the event of a divorce.

The law is not always black and white, but shades of grey. If you have any legal issues troubling you, it would be best to consult a practicing lawyer.
