I just received my keys for handover of my rental unit. The place smelt ok the day of handover, 24 hours later the whole house stinks of smoke odour. It's not coming from outside but inside from the walls. I wrote to the agent about this but they are deflecting. I have aging parents who are coughing badly and I'm worried for their health. I too have allergies and can't breathe clearly sometimes. I have engaged cleaning service to come clean and maybe it will go away. Honestly want to exit this lease and find somewhere more accommodation. What are my options?

If you are asking from legal perspective, you may wish to consult a professional legal consultant to see what your options are. If you are looking at removing the odour, I'd reckon that ionisation of the place will help get rid of the smell. Read More

Addressing the Issue with the Landlord:

Documentation: Keep copies of all communication with the agent regarding the smoke odor.

Repair Request: Submit a formal repair request to the landlord detailing the severity of the odor and its impact on your health and parents' health. Mention the cleaning service you engaged and attach receipts if possible.

Health Professional: Consider getting a doctor's note documenting the respiratory issues caused by the smoke odor. This strengthens your case.

Negotiation:

Rent Reduction: If the odor persists despite repairs, negotiate a rent reduction for the inconvenience and health risks caused.

Early Termination: If the issue isn't resolved and it significantly affects habitability, explore early termination of the lease agreement. Carefully review your lease agreement for termination clauses and potential penalties.

Seeking External Help:

Legal Advice: Consider consulting a lawyer specializing in tenancy law if communication with the landlord breaks down and you need to pursue further action.

Remember:

Maintain Records: Keep copies of all communication, repair requests, and receipts related to the smoke odor issue.

Health Comes First: Prioritize your and your parents' well-being. If the odor significantly impacts your health, consider alternative accommodation while seeking resolution.

By following these steps and documenting everything, you can increase your chances of resolving the issue and protecting your rights as a tenant.
