I have recently moved to Singapore. While doing a house hunting I liked an apartment and entered into negotiations with the agent over whatsapp. We discussed rent, lease, date of commencement etc. She as a response shared with me the tenancy agreement to sign and landlord's account no to deposit the money, Before I could do any of this I got the chance to see another property that I liked more and is more suitable to my requirements. On telling this to the agent she reacted in a negative manner and also said she will inform all agents about me. She also has copy of my pass and passport that she used to prepare the agreement. Need suggestion on the way forward here. Frankly speaking I understand her situation. My backing out must have made her look bad in front of her client and I did apologize to her but her response could have been and should have been different.

You are protected under PDPA regulations that your information cannot be shared to others as per what has been described.

This agent took the risk in presenting an offer that was not firm in the first place to the owner because a firm offer has to be accompanied with a consideration in the form of good faith deposit to be proper. If she indeed goes around spreading this to other agents, you can formally lodge a complain against her misconduct.

You’re in a tricky but not unusual situation. A few key points to keep in mind:
1. No Binding Agreement Yet – If you haven’t signed the tenancy agreement or transferred any money, there is generally no binding contract. Until then, you are free to choose another property.
2. Personal Data – Agents having your passport or pass copy is common for drafting agreements, but they cannot misuse it. If you feel threatened or if they actually try to spread your personal information, that could be a breach of data protection laws (PDPA in Singapore).
3. Professional Conduct – Threatening to inform other agents about your backing out is unprofessional and not enforceable. Other agents cannot refuse to deal with you based on one agent’s word.
4. Your Response – You’ve already apologised, which is appropriate. You can also document all communications (WhatsApp chats, emails) just in case any dispute arises.
5. Future Precautions –
• Only sign agreements when you are certain.
• Avoid sharing sensitive documents until you are ready to commit.
• Always keep a record of all interactions with agents.

Since you have yet to transfer the money or sign the tenancy agreement, you are free to back out. The agent is also not allowed to share your personal information with others so you are protected.

Nevertheless, it sounds like you are going around directly dealing with landlord agents instead of having a tenant agent on your side.

While it might sound more straightforward now, this is actually a risky move. You may wish to have a tenant agent supporting you as you will be much better protected not only during the negotiation and signing phase but during the actual tenancy as well as the eventual handover of the unit back to the landlord.
