Hi, as long as the TA is not signed yet, the landlord could back out too and return the deposit.

Hi,

The law of contract states that there must be the following elements for a contract to be binding:
1. Intention to create legal relations
2. Offer (such as issuing a Tenancy Agreement)
3. Acceptance (tenant has signed Tenancy Agreement)
4. Consideration (Money a deposit as a promise to rent the property)

Since there is no signed Tenancy Agreement, there is no contract and is not legally binding.
