I have a son who is mentally ill, under medication and is in stable condition. He is 30 years old and single. We would like to help him buy a resale HDB 4-room flat in 5 years time when he turn 35, so that we can move in with him and rent out our present 4-room flat to give him some income as he is not able to work. Is it advisable to do that? If his mental condition deteriorates after buying the flat, is there any problem selling his flat in the sight of the law? Is there any legal problem involve for a mentally ill person to buy or sell a HDB flat that you can forsee. Please advise. My husband and I are in our mid-fifties. Thank you.

Evening,

There are a few factors to overcome:

1) Being mentally handicap, all documents signed by your son holds no value, in the eye of the law. Under Mental Capacity Act, a doctor report is required to identify his condition and assigned trustee to act on his behalf. Such legal procedure would normally take around 6 to 9 months, depending on the complexity of case and Judge involved.

2) As he's not able to work, who will be borrower for the mortgage loan? What type of loan quantum would be available?

3) For Mental Capacity Act, the trustee allocated should last for life time or till the time he have being medically proven for recovery. If your son's case deter and selling is required, you need to get another court order which determine on the caregiver and allocate the duty of the trustee.

I have managed to assist my seller on sales under mental capacity act but not for purchase. It would be good to talk to relevant lawyer when it's closer to the period to date of purchase.
