I have a HDB under solely my name and I will be getting a new HDB with my fiancé. I am thinking of transferring the current HDB to my mother (she does not hold any property to her name). If I would to transfer the flat to her, is there any way to prevent her from selling the flat without my consent?

Congratulations on the upcoming wedding. Current HDB regulations do not allow outright transfer of ownership of the HDB flat, however, you may look into the possibility of having your mum buy over the current HDB if she has the necessary finances to support the purchase as well as if she fulfils the eligibility to own a resale HDB flat based on the schemes available.

Hi,

In order to "transfer" the flat to your Mother, she will need to have the financial capability to "buy over" the flat from you.

For example, she will need to refund whatever CPF monies that you had utilised for the flat, plus accrued interest. If there is an outstanding loan, she will also need to be able to support the loan with her MSR/TDSR.

Stamp duties are applicable for transfers too.

And lastly, she do not need your consent should she decides to sell off the flat in the future, as she is the owner of the flat.
