I have a HDB together with wife and I have a condo with my own name.
We are getting a landed property with my wife's name and selling the HDB. Can I still claim back the ABSD and how many percent?

Hi Sir,

I assume you and your wife are both Singaporeans? If you are looking to save on ABSD, I suggest that you sell off your jointly-owned HDB first, then using your wife's name, proceed to buy the landed property. This way, your wife will be buying her first property and will not be subjected to any ABSD.

However, if she were to proceed to buy the landed property first, and then sell off your jointly-owned HDB flat, I am sorry to inform that she is liable to pay ABSD of 7% for her second property (landed), and she will not be able to claim back ABSD refund.

This is because, ABSD refund is only applicable for Singaporeans buying their matrimonial home (jointly-owned).

Hi,

In this case it will be better to sell off the HDB first before buying the landed under your wife's name, so you can avoid the ABSD.

If she were to buy the landed first before selling the HDB, she will be subjected to ABSD for the purchase and cannot claim ABSD refund.

This is because ABSD refund is only for SC couples jointly purchasing a matrimonial property (joint-name purchase) and disposing all of their previous ones.

The ABSD paid during the purchase of your current condo cannot be claimed back. However, you can save up on the ABSD payable for your Wife's purchase by selling the HDB first.

There is no ABSD remission in your case should you decide to purchase before the sale of your HDB. Look into the sale of HDB first. I do not think it will be a major obstacle for you to sell your HDB unless pricing expectations is not in line with existing trend, but bearing in mind that you are looking to leverage on the existing market to purchase a landed home, your advantage is obviously in savings in terms of purchase price on your purchase given the current climate.

However please note extra cost 7% ABSD additional buyer stamp duty if your wife buy a landed property before selling your family hdb .

Vise versa, savings of 7% ABSD If your family sell the hdb before buying a landed property .

Kindly note your wife TDSR total debt servicing ratio , if loan is required for the landed property , TDSR is subject to her age and income , you cannot get a loan for the landed property if your name is not included as owner .

Given the limited info provided by you ,

Your family may claim back the ABSD payable for the landed property , if this few conditions are met .

1.must sell the condo before purchasing any property .

2. Buy the landed as a one and only , jointly-owned , singapore household , matrimonial home to qualify for ABSD remission ( pay ABSD first but claim back in full later , if sell the hdb property withins 6months from landed property purchase ) .

Please note there is a risk of forfeiting ABSD paid if fail to sell hdb by dateline of 6months .

3 . Alternatively , sell both hdb and condo before buying the landed property , therefore NO ABSD payable upfront .
