I attended a USA property sales exhibition recently. I paid the booking fee and signed the booking fee form & purchase contract. After go home, realised that booking fee only refundable if I complete the purchase. There is no mention of conditions for non-refund of booking fee and no cooling off period.
can I ask:
1.Is this booking fee terms fair?
2. the purchase contract assumes that I buy "as is where is" and states that I had inspected the flat which is not factual. I did not have time to clarify at the sale exhibition as the sale persons were busy.
Now I decide not to proceed since the above term in purchase contract is not fair, do you think the booking fee is refundable?
3. is the governance of overseas property sold in Singapore by Singapore real estate agents on same basis as local property?
4. is cooling off period a must in booking contract? purchase contract?
