I am purchasing a HDB resale flat under the non-Citizen Family Scheme. One of my parents has LVTP and the other has to be put under "Occupier" due to their legal "married" status.
Both have properties in Malaysia. What would be the best way to appeal in this situation so that my HDB purchase can be approved?

Hi,

1) Your parent with LTVP will be the essential occupier under your situation. Meaning he/she will have to endorse the document submitted for this purchase.
2) Please ensure he/she has a singpass in order to complete the application.
3) The other parent who does not have an LTVP will be a normal occupier. Because they are still in a marriage relationship, his/her name also needs to be included in the application list as one of the occupiers.
4) As for owning property overseas. This will be tough to get a successful appeal. You must understand from the HDB position that no one supposes to gain an advantage from buying an HDB flat. Because owning an HDB flat is a privilege that only provides for the citizen and permanent resident.
5) Therefore no one should have an advantage against another. This was the main reason why there is this restriction of not owning the local or overseas property after the purchase.
6) Unless you can prove that these properties owned are not for profit-making but for needs, for example, an immediate family that depends on it to have a roof overhead.
7) Otherwise your parents will have to sign an undertaking letter to promise to sell them away within 6 months upon key collection of your purchased HDB. Failure to do so after 6 months will bring uncontrollable consequences to your purchase.
