When a divorce is involved, HDB requires both owners to be part of the sale process unless there is a court order stating otherwise. If you do not wish to communicate directly with your ex-spouse, you can appoint an agent to handle all coordination and communication on your behalf. We liaise with both parties separately so you do not need direct contact at all.

Steps normally look like this:
1. Confirm your eligibility to sell with HDB after divorce
2. Provide the divorce documents and any court orders
3. Authorise a salesperson to represent you
4. We handle viewings, buyers, paperwork and keep both sides updated separately

If there is no court direction on who handles what, HDB will simply expect both owners to sign documents, but again, this can all be managed without you needing to communicate with them personally.

May I know if your court order final judgement is out? And is the matrimonial property required to be sold in the open market? If it is a HDB, has the MOP of 5 years already being fulfilled? Are both of you still staying in the property?

You could communicate through the law firm representing either of you, or a loved one such as the parent that is still talking to both of you. The agent will be able to assist more on the housing sale matters, when both of you are ready to go through with the sale process.

I am sorry to hear about your situation. For matrimonial splits, the HDB can only be sold when there is a final judgement and in this case, both owners will need to sign on the Option To Purchase when the offer is right. The key thing if you do not wish to contact your co-owner will mean that someone else will need to speak and convey any messages to and fro.

Hi,

1) Not all the separation is a happy event, however, whatever need to be done has to be done.
2) I assume this HDB is co-owned by both of you, therefore, you have to settle this before moving on.
3) There are things that need to confirm after the final court order issued:
(a) Has the interim court order clearly state how much each party will get?
(b) Was there a mention of whether one party can buy over the other party's shares.
(c) Can the buying party retain the HDB flat after the legal separation?
4) Once it is confirmed that both parties wanted to sell the flat, divide the sales proceeds and move on.
5) I would suggested to appoint an agent to handle the communication between both parties.
The agent can be appointed by either party or both.
6) The agent will assist sellers in registering the intent to sell and market the HDB flat in the open market as soon.
7) OTP can be issued after 7 days cooling period once there is a buyer willing to pay the agreed price.
8) Both parties has to sign the OTP in order to be legit.
9) Engage a private lawyer to handle the conveyance so that both of you do not need to be present at the completion.
10) The agent can also helps ino running the errands in settling final payment of town council fees so that none of you need to handle the selling, inspection, etc.
