Hi! Would like to know is it a common practice to add in an additional third occupant in the Tenancy Agreement though the Letter Of Intent was signed off with two occupants. Have trusted the professionalism of the agent thus signing off the Tenancy Agreement without doing a thorough check where an additional third handwritten occupant name was added. Please advise how to deal with this situation.

Hi, there is always room for negotiation. As a landlord, you could just allow it, reject signing the TA or increase rental slightly by a bit more as there is now an additional occupant.

Dear landlord,

This is not my first encounter with such a concern to be frank but it wasn't a transaction handled by me but a concerned landlord who called me where she faced similar issue too.

A tenancy agreement is a private contract between the landlord and the tenant. I am unsure how the 3rd name was added into the tenancy agreement without your agreement to it. You do have your rights to impress upon the original terms and conditions of the rental, where implementation of your rights legally will require a lawyer to do so.

In my opinion, it is best to look into the overall situation, whether are you being subjected to any material loss in having an additional occupant in the apartment, and whether the profile of this person is going to subject the apartment to significantly more wear and tear, or even if this person is legally alright to be an occupant in this apartment. Ultimately, as a landlord, the primary objective is to rent out the apartment at a reasonable rental rate, and subsequently taking over the apartment when the lease runs out where apartment is well taken care of.
