Hi we own a condo with an outstanding loan of 65k. Can we transfer this condo as a gift to our daughter who is 28 yrs old and then can we purchase a resale or new hdb flat or an EC? What are the implications and legal costs involve? Many thanks!

Hi Sir/Mdm,

1. Yes, you may transfer the condo as a gift to your daughter. However, do note that the basic stamp duty will still apply.

2. You can purchase a resale flat in the open market after the transfer. BTO and EC are not possible as there is a waiting period of 30 months. ONly after 30 months then you will be eligible.

Hi,

Yes you can transfer as gift but relevant stamp duties will apply. You can't purchase BTO or new EC as you need to wait out a 30 month period. Thanks and perhaps I can link you up with my legal partners & discuss further on the process?

You can transfer to your daughter. But have to wait for 30 months before apply new EC. Why not consider private condo or 5 years old EC.

Hi parent,

You may transfer the condo to your daughter, noting that:
1) you need to have owned the condo for >4 years in order not to incur SSD
2) your daughter would be liable for BSD based on the market value, not value you bought the condo at

As for new HDB or EC, you'd have to fulfill a 30-month wait out period, and fulfill the income and other requirements.

I'd suggest resale HDB/EC/condo if you want to do it now.
