Hi, We have rent one whole house with 2 years lease agreement. Now we got our own house and want to move without finish 2 years lease. In that case, do we need to forfeit our 2 months deposit even didn't write any clause at the agreement letter? At the agreement letter, only write to pay prorated for agent fee if any party terminate early.

Without examining the contents of your tenancy agreement, we are unable to advise you accurately on what are the terms applicable for premature termination of lease.

In majority of rental transactions I have handled, other than diplomatic clause applicable for 2 years lease, where the foreign employment pass holder can exercise if they are relocated out of Singapore due to employment reasons, there is no possible premature termination. Tenant will be liable to pay up whatever rental amount that has not been paid for the duration of unfulfilled rental too, unless landlord agrees out of goodwill for premature termination.

Morning,

Depending on the content of the TA, you will most likely forfeit the 2 months deposit. The landlord do also reserve to right to claim for full compensation should the TA calls for it.

Assuming its a "standard" Tenancy Agreement, look at the security deposit clause. If Tenant don't fulfill their obligations to the terms of the contract, the deposit will be forfeited.

Something like this:
Agreement (the receipt whereof the Landlord hereby acknowledges) as security for the due performance and observance by the Tenant of all covenants, conditions and stipulations on the part of the Tenant herein contained, failing which the Tenant shall forfeit to the Landlord the said deposit or such part thereof as may be necessary to remedy any such default.
